HIPAA & E-mailing Concerns
In response to the increased use of the Internet in medical practices, the State of Indiana Medical Licensing Board developed and introduced amendments to Title 844 of the Indiana Administrative Code (IAC). The amendments were adopted and became effective on November 1, 2003. This part of the IAC governs the Medical Licensing Board of Indiana and their authorities. In addition to amendments to definitions and disciplinary action, the following two sections were added to 844 IAC: 844 IAC 5-3 (Appropriate Use of the Internet in Medical Practice) and 844 IAC 5-4 (Prescribing to Persons Not Seen by the Physician). Any person who holds an unlimited license to practice medicine or osteopathic medicine in Indiana must comply with this regulation if he/she is utilizing the internet in the delivery of patient care.
